OTR Construction inc. (hereinafter "OTR Construction", "we", "our") is responsible for the protection of personal information it collects, uses and discloses in the course of its business activities.
In accordance with section 3.1 of the Act Respecting the Protection of Personal Information in the Private Sector (ARPPIPS), as amended by Law 25, the Privacy Officer is:

2. Scope of this Policy
This Privacy Policy applies to all personal information collected by OTR Construction inc. in connection with the operation of the website www.otr-construction.com (hereinafter "the Site"), its communications with clients and prospects, and the provision of its residential renovation services.
It applies to any natural person residing in Quebec or elsewhere in Canada whose personal information is processed by OTR Construction. It complies with the requirements of the Act Respecting the Protection of Personal Information in the Private Sector (ARPPIPS), as amended by Law 25 (S.Q. 2021, c. 25), which came into force progressively between September 2022 and September 2023.
3. Personal Information Collected
OTR Construction collects only the personal information necessary for the purposes described in this policy, in accordance with the principle of data minimization.
3.1 Information collected through the contact and quote request form
When you complete our quote request or contact form, we collect the following information: your first and last name, your phone number, your email address, the nature of your renovation project (type of work, approximate budget), and any other information you choose to provide in the free description field.
3.2 Automatically collected information
When you browse the Site, certain technical information may be collected automatically, including your IP address (transmitted to Google's servers when loading fonts via Google Fonts), and anonymized browsing data (pages visited, visit duration, device type) via our Umami Analytics audience measurement tool, subject to your consent.
3.3 Information not collected
OTR Construction does not collect financial information (credit card numbers, banking details), sensitive information as defined by law (health data, ethnic origin, religious or political beliefs), or information about children under 14 years of age.
4. Purposes of Collection and Use
The personal information we collect is used for the following purposes, which are communicated to you at the time of collection:
Processing quote and contact requests, Analyzing your project, preparing a personalized quote, contacting you to arrange a meeting or answer your questions. Legal basis: performance of a contract or pre-contractual measures at your request.
Client relationship management, Following up on your renovation project, sending you contractual documents, invoices and communications regarding the progress of the work. Legal basis: performance of a contract.
Improvement of our services, Analyzing requests received in an aggregated and anonymized manner to improve our service offering. Legal basis: legitimate interest of OTR Construction.
Site audience measurement, Understanding how visitors use our Site in order to improve its content and user experience, via Umami Analytics. Legal basis: user consent.
Compliance with our legal obligations, Retaining accounting and contractual documents in accordance with applicable tax and legal obligations. Legal basis: legal obligation.
OTR Construction does not use your personal information for direct marketing purposes without your prior consent, and does not engage in automated profiling with legal or significant effects on your situation.
6. Disclosure of Information to Third Parties
OTR Construction does not sell, rent or transfer your personal information to third parties for commercial purposes.
Your information may be disclosed in the following cases:
Subcontractors and service providers, OTR Construction may engage third-party service providers for Site hosting, email sending or client relationship management. These providers only have access to the information strictly necessary for the performance of their services and are contractually bound to protect it in accordance with Law 25.
Legal obligations, OTR Construction may be required to disclose your personal information if required by law, including in response to a court order, subpoena or request from a competent government authority.
Business transfer, In the event of a merger, acquisition or sale of all or part of OTR Construction's assets, your personal information may be transferred to the successor entity, subject to compliance with the obligations of Law 25.
No transfer of personal information outside Quebec is carried out without appropriate protective measures being put in place, in accordance with section 17 of the ARPPIPS.
7. Retention Period
OTR Construction retains your personal information only for as long as necessary for the purposes for which it was collected, or to satisfy its legal obligations.
Information relating to quote requests that did not result in a contract is retained for 12 months from the last communication, then securely destroyed. Information relating to concluded contracts is retained for 7 years from the end of the contract, in accordance with applicable tax and accounting obligations in Quebec. Anonymized browsing data collected via Umami Analytics is retained for 24 months, then automatically deleted. Cookie consent preferences are stored for 12 months in your browser.
Upon expiry of the applicable retention periods, personal information is destroyed or anonymized in a secure and irreversible manner.
8. Your Rights
In accordance with Law 25, you have the following rights with respect to your personal information held by OTR Construction:
Right of access, You have the right to request access to the personal information we hold about you, as well as information about how it is used and disclosed.
Right to rectification, You have the right to request the correction of any personal information about you that is inaccurate, incomplete or ambiguous.
Right to erasure (right to be forgotten), You have the right to request the deletion of your personal information when its retention is no longer necessary for the purposes for which it was collected, subject to our legal retention obligations.
Right to portability, You have the right to receive your personal information in a structured, commonly used technological format, and to have it transmitted to a third party, where technically feasible.
Right to withdraw consent, Where the processing of your information is based on your consent, you may withdraw it at any time, without affecting the lawfulness of processing carried out before such withdrawal.
Right to file a complaint, If you believe that your rights have not been respected, you may file a complaint with the Commission d'accès à l'information du Québec (CAI) at www.cai.gouv.qc.ca.

9. Security Measures
OTR Construction implements appropriate technical and organizational security measures to protect your personal information against unauthorized access, disclosure, alteration or destruction.
These measures include: encryption of communications via the HTTPS (TLS) protocol, access control to systems containing personal information, training of staff on personal information protection obligations, and the implementation of privacy incident response procedures.
In the event of a privacy incident presenting a risk of serious harm to an affected person, OTR Construction undertakes to notify the Commission d'accès à l'information du Québec and the affected persons as soon as possible, in accordance with section 3.5 of the ARPPIPS.
10. Information Concerning Minors
OTR Construction's Site is not intended for persons under 14 years of age. OTR Construction does not knowingly collect personal information about children under 14 years of age without the prior consent of their parents or legal guardians, in accordance with section 4.1 of the ARPPIPS.
If you are a parent or guardian and you discover that your child under 14 has provided us with personal information without your consent, please contact us immediately at [email protected] so that we can proceed with its deletion.
11. Changes to this Policy
OTR Construction reserves the right to modify this Privacy Policy at any time to reflect changes to its practices, applicable legislation or its services. Any material changes will be communicated to affected persons by a notice posted on the Site or by email, as appropriate.
The date of the last update is indicated at the top of this policy. We encourage you to regularly consult this page to be informed of any changes. The version in force is the one published on the Site at the time of your consultation.
